These Terms of Service (“Terms”) govern your access to and use of the PeekShot website, dashboard, APIs, and all related products and services (collectively, the “Service”), operated by 9Ethics Info Solutions LLP (“PeekShot”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. The Service

PeekShot provides a subscription-based API and dashboard that enables users to generate website screenshots and related rendered content programmatically. The Service may evolve over time, and we reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration

To access certain features of the Service, you may be required to create an account. You agree to:

Provide accurate, complete, and up-to-date information
Maintain the confidentiality of your account credentials
Be fully responsible for all activities that occur under your account

You must notify us immediately of any unauthorized use of your account.

4. License and Acceptable Use

4.1 License

Subject to your compliance with these Terms, PeekShot grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal business or personal use.

4.2 Restrictions

You agree not to:

Use the Service in any way that violates applicable laws or regulations
Abuse, overload, disrupt, or interfere with the integrity or performance of the Service
Attempt to gain unauthorized access to the Service, systems, or networks
Use the Service to scrape, capture, or process content in violation of third-party rights or terms
Reverse engineer, decompile, or attempt to extract the source code of the Service
Resell, sublicense, or make the Service available to third parties without prior written consent

5. API Usage and Fair Use

Use of the PeekShot API is subject to plan limits, rate limits, and fair-use policies. Excessive usage, abuse, or attempts to bypass technical limitations may result in throttling, suspension, or termination of access.

6. Fees and Payments

Certain features of the Service require payment of subscription or usage-based fees. By subscribing, you agree to:

Pay all applicable fees in accordance with the selected plan
Provide valid and up-to-date payment information

All fees are non-refundable except where required by law or explicitly stated otherwise.

7. Intellectual Property

The Service, including all software, APIs, documentation, designs, trademarks, and content (excluding user-provided content), is owned by PeekShot or its licensors and is protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.

8. Termination and Suspension

We may suspend or terminate your access to the Service immediately and without notice if:

You violate these Terms
Your use poses a security, legal, or operational risk
Required by law or regulatory authority

Upon termination, your license to use the Service will immediately cease.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, PeekShot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of or inability to use the Service.

In no event shall PeekShot’s total liability exceed the amount paid by you to PeekShot for the Service in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless PeekShot and its affiliates, partners, and employees from any claims, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. The latest version will always be posted on our website. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Courts located in India shall have exclusive jurisdiction over disputes arising under these Terms.

14. Entire Agreement

These Terms, together with the Privacy Policy and any applicable order forms or plan descriptions, constitute the entire agreement between you and PeekShot regarding the Service and supersede all prior or contemporaneous agreements.
